Governing Legislation: Philippines
Labor Code of the Philippines (Presidential Decree No. 442) & Special Statutes
Under the Labor Code of the Philippines (PD 442) and subsequent special social legislations, employers in the Philippines are required to provide several mandatory paid leaves. Unlike many jurisdictions with standard 15-day vacation leave mandates, Philippine statutory law requires a baseline of at least 5 days of Service Incentive Leave (SIL) after 1 year of service, but provides robust special statutory leaves: 105 days of Expanded Maternity Leave, 7 days of Paternity Leave, 7 days of Solo Parent Leave, 10 days of VAWC leave, and up to 2 months of special leave under the Magna Carta of Women.

Common Employer Pitfalls
Treating SIL as 'use it or lose it' without cash commutation
Consequence: Labor inspection findings and back-pay claims filed with the DOLE National Labor Relations Commission (NLRC).
Compliant Action: Convert any unused SIL balance to cash at the end of each calendar year.
Refusing to pay the employer maternity salary differential
Consequence: Violations of RA 11210 penalized by fines of PHP 20,000 to PHP 200,000 and business permit revocation.
Compliant Action: Calculate salary differential in payroll and disburse according to standard payroll cycles.
Counting public holidays against SIL or vacation balances
Consequence: Illegal wage deduction claims under the Labor Code.
Compliant Action: Ensure HR software automatically filters out regular and special holidays when employees take multi-day leaves.
