Official Holiday Pay Regulations: Malaysia (2027)

Under Section 60D of the Malaysian Employment Act 1955 (amended 2022/2023), every employee is entitled to a paid holiday at their ordinary rate of pay on eleven (11) gazetted public holidays in any one calendar year. Five (5) of these are mandatory: National Day, Birthday of the Yang di-Pertuan Agong, Birthday of the Ruler/Yang di-Pertua Negeri or Federal Territory Day, Labour Day, and Malaysia Day. The remaining six (6) holidays are chosen by the employer from the gazetted national list.

Work on a Paid Public Holiday
Under Section 60D(3), an employee who works on a public holiday is entitled to two (2) days' wages at the ordinary rate of pay, in addition to the holiday pay they are entitled to for that day (effectively triple pay or 300% for the day's standard hours).
Overtime on a Public Holiday
Work exceeding standard daily hours on a public holiday must be compensated at not less than three (3) times the hourly rate of pay (3.0x hourly OT rate).
Replacement Holiday (Sunday Rule)
If any public holiday falls on a rest day (typically Sunday), the working day following immediately thereafter (Monday) becomes a paid replacement holiday in substitution under the Holidays Act 1951.
Unworked Public Holiday
Employees are paid their regular ordinary rate of pay. However, an employee who absents themselves without leave or reasonable excuse on the working day before or after the holiday is not entitled to holiday pay.
